The Real Facts on Auto No-Fault

by Tim Hoste

In the January 22, 2015 Detroit Free Press, readers were greeted by a full page advertisement about the Michigan Catastrophic Claims Association (MCCA).  In what appears to be nothing more than a poor attempt to gain attention for a new radio program on a small time, low end of the dial radio station, this sub par attempt at "informing" the public is missing one important element...fact.

The first glaring statement that proves this advertisement is nothing more than a poorly worded opinion piece is the reference to the MCCA having $20 billion in the fund.  The total amount of money in the MCCA's fund has been at the forefront of many auto no-fault related discussions for a number of years now, and even after numerous Freedom of Information Act requests and court battles, no definitive number has ever been presented.  There has long been speculation as to the amount of money in this fund, as well as its overall sustainability, but as described in numerous independent audits of the MCCA, the Michigan Catastrophic Claims Association uses accounting practices which differ from accounting principles generally accepted in the United States of America.[i]  This statement alone proves that before any statement can be made as to the financial status of the MCCA, further information is needed to truly understand the viability of the fund.

The second statement that shows whoever authored the advertisement does not have a strong understanding of how the MCCA operates in the sentence that reads, the MCCA reimburses a very small percentage of those not playing by the rules, meanwhile, a high percentage of people who play by the rules are paying for all of this.  The MCCA is simply a re-insurer for any insurance company that writes auto insurance policies in the State of Michigan.  While the responsibility of each claim falls on the various insurance companies, the MCCA will reimburse them for every dollar spent beyond the first $530,000.  The purpose of the MCCA was to even the playing field for all auto insurers, and help ensure that the smaller companies could still write policies in Michigan, which requires all reasonable charges incurred for reasonably necessary products, services, and accommodations for an injured person’s care, recovery or rehabilitation be covered for the accident victims lifetime.  That was and is all the MCCA does, so it is unclear as to how they only reimburse a very small percentage, when they reimburse ALL auto claims that exceed $530,000.

The third statement that continues to show the lack of knowledge from the people behind this advertisement is the one line that reads, We are for everyone who legitimately need assistance from this fund! (not the lowlifes who take advantage).  Once you look past the unnecessary use of slanderous rhetoric, this statement contradicts their text box on the right side of the page that says, Place a $500,000 cap on current and future claimants.  The reality is that anyone who sustains a catastrophic injury (such as a traumatic brain injury or a spinal cord injury), $500,000 will not even come close to covering the appropriate levels of care and rehabilitation they will require throughout their lifetime.

It is my sincere hope that whoever is responsible for this advertisement truly takes the time to learn the facts of Michigan's Auto No-Fault Insurance and the Michigan Catastrophic Claims Associations.  All Michigan residents are fortunate to live in a state that allows all accident victims the chance to have a good quality of life post injury.  In other states, the sad reality is that if you get injured in an auto accident, financial ruin for you and your family occurs, followed up by the remainder of your life is spent in a state-run nursing home.

If the "Ask Detroit" radio show and the staff at 680AM WNZK really want to delve into this topic, the focus should be on the MCCA and their refusal to present the real financial data that is needed to truly understand the status of that fund.  Or, they can focus on why the State of Michigan allows your credit score, occupation, level of education, and residential address to factor into to how much your pay in auto insurance premiums.  Better yet, I urge the hosts of "Ask Detroit" to spend some time learning the truth about Michigan Auto No-Fault Insurance, and witness firsthand some of the therapies and rehabilitation that are quintessential to the recovery and well being of auto accident victims.

If the hosts of "Ask Detroit" or any other media member would like to learn more about Auto No-Fault, please do not hesitate to contact me at thoste@uniqueoptionsllc.com.  It is my goal to help everyone understand just how critical Michigan's Auto No-Fault System is to not only those who currently need it, but to anyone who might need it in the future.

In a split second an auto accident can change someone's life forever, it could be yours.  What type of auto insurance coverage would you want?

Reflections

I started working at Unique Options on June 15th, 2010. This was after I acquired my TBI from an auto accident in 2009, on a road trip with my dad. In memory of him, I want to honor my late father as best I can. I have had a long road of recovery (wheelchair, walker, cane, etc.), but am making progress towards independence. Now, Unique Options has a variety of jobs, including an Enclave program I am currently enrolled in. My dad was a Quality Engineer during his lifetime, and I am now doing similar work for the same company my dad worked for in the early 90’s. Stuff comes around full circle! Things are good here at Unique Options, and I want to see everyone succeed!

See Unique on CBS Eye On Detroit!

On Monday, January 5th, 2015, we were fortunate to have the opportunity to invite the CBS morning show, Eye on Detroit, into our facility. We toured them through our warehouses to watch how our clients work and what type of production we complete in-house. Our featured segment aired on January 8th, between 7:30 a.m. - 9:00 a.m. We thank CBS for taking the time to showcase our program! We know the segment was short, so here is a short list of some of the most pertinent questions you may have...

We are a State of Michigan approved vocational rehabilitation facility for individuals who have sustained traumatic brain injuries. While many of our clients have sustained their injuries due to motor vehicle accidents, others have received theirs while on the job.
  • What type of work can clients participate in at Unique Options, LLC?  Our program allows the clients to work on vocational skills that are required in today's workplace environments. It's Easy To Avoid Drinking and Driving

New Year's Eve is a time for celebrating with loved ones and looking forward into the future for all of the great things to come. Are you excited about your vacation to warmer weather on the horizon? How about your increased motivation to become a better team member at work? Or what about making an active effort to spend more quality time with family and friends? We want to encourage and help you follow the course with your goals and positive plans for the upcoming year. The best way to stay on track this New Year's Eve is to remain safe and smart about drinking and driving.

The best way to avoid issues around drinking and driving is to simply not do it! Are you worried you'll  be stuck at a party and have no way home? Plan ahead by scheduling a family member or friend to come pick you up at a certain time. Didn't anticipate having that one extra drink? Cabs and transportation companies are ready for your calls this evening! Better yet, if you have the opportunity to stay put, enjoy your evening and don't worry about getting back on the road. Whatever your New Year's Eve plans bring, we hope that everyone remains safe and sound, and brings in 2015 with nothing but love and happiness!

Holiday Party

Sometimes we like to combine our work with a little fun! Would you like to join in on our holiday celebration? Let us know! We'd love to see everyone who helps support us year round!

Reflections

I started working at Unique Options, LLC as of October 2012. I do all kinds of jobs with different kinds of car parts, and many different kinds of assembly jobs. In the Spring and Summer I enjoy working out in our garden. I find it very relaxing and you can work at your own pace. I feel a lot stronger working here and my thinking is much better. I also enjoy working on wood furniture stripping the old stain off and also putting a new finish on it. I find this very relaxing as well. I also enjoy making birthday cards on the computer each month, for other employees. All the staff is very helpful and eager to help us, if we have a problem with a job.

Reflections

I started at Unique Options, LLC in June of 2012. It was rough at the beginning, but as time went on, the staff here has helped me with whatever I need them for. I love gardening and working in our store to help other clients with whatever they need. My favorite production job is Stand-Out Cards. I love how if I’m having a problem I can go to any of the directors or management, and they will help me calm down. They tell me I have a lot of potential, and that’s why I look up to them. They’re great people. My experience at Unique Options, LLC has been great!

Driving Safe All Winter Long

As icy and snowy conditions start to creep into Metro Detroit, it’s important to remember to stay safe on the road. Keep yourself safe this winter, and read over some of Unique Options’ safe driving tips, to ensure that you make it to all of your destinations without any issues!

  • Plan ahead – Make sure to always give yourself extra time to reach your destination, during the winter. You never know what rough patches may come along across the way.
  • Wait for snow plows – Give salt trucks and snow plows time to clear the streets before venturing out into the snow. Additionally, if you are driving around one of these assistive vehicles, leave them plenty of room to do their job, and do not try and pass them.
  • Practice driving in the snow – If you have the opportunity to go to an open lot when it snows, practice some emergency reactions with your vehicle. The more you understand how to maneuver your car in tricky situations, the more prepared you will be.
  • Drive slowly – Decrease your speed while driving during icy and snowy conditions, and leave ample amounts of space between you and the cars in front of you. Additionally, do not use cruise control during the winter months or when the roads are extra icy.
  • Brake carefully – Be gentle on your breaks, and you will avoid skidding across the road when it is icy. If you feel your wheels being to lock, start to ease up on the breaks.
  • Keep your car clean – This means your lights, windshield, and any other areas you or the cars around you need to visibly see. In the winter months the sun sets sooner, which will make this tip extra important while driving in the dark more often.
  • Drive slowly over bridges – Be mindful of overpasses, bridges, and any other roads that are not traveled often. If any of these areas are wet or damp, hidden pockets of ice can form, so be extra careful!
  • Don’t drive at all – If you can avoid going out in treacherous conditions, please chose to stay at home. Don’t assume that your car, no matter how equip for the snow it is, can handle all dangerous weather. No trip is worth your safety or life.

When it comes to ice, snow, and heavy winds, being cautious is key! Unique Options values your safety and hopes you play it smart on the roads this season. What are some of your best tips for handling cold weather travel?

Reflections

Working at Unique Options, LLC has really been a wonderful experience thus far. When I first started working at Unique, I didn't know what to expect, especially since I had never heard of a sheltered work place. The staff was welcoming and supportive with helping me and others with restrictions we had. The Unique Options staff treats you with dignity, respect, and understanding. They're very patient with the clients and work closely with us. They show us how to work on different jobs, and we help build assistive devices that are called 'jigs,' for other clients. I've been a client here for 5 years, and working here has helped me become a person who looks at life in a positive and progressing way. Unique Options has helped me take on more tasks, strengthen my problem solving skills, obtain my GED, learn how to work with groups of people better, and attain personal goals.

Fundraiser for Judge Bill Murphy

A big thank you goes out to everyone who attended our fundraiser on September 23rd for gubernatorial candidate Mark Schauer.  We had an amazing turn out and Mr. Schauer was extremely grateful for all of the support he received that evening.  As you are aware, Mr. Schauer is a huge supporter of Michigan's Auto No-Fault system, and believes strongly in protecting the reasonable and necessary medical care and rehabilitation that all victims of catastrophic auto accidents receive from these benefits.

As we get closer to election day, we wanted to inform you of another fundraiser that is taking place.  This event is for Judge Bill Murphy who is a candidate for the Michigan Supreme Court.  Judge Murphy has served on the Michigan Court of Appeals for 26 years and has been appointed Chief Judge three times, a position he currently holds.  During his tenure, he has approached all cases relating to auto no-fault in a manner that ensures any decision that is rendered is consistent with the specific language of the Michigan No-Fault Act.  Chief Judge Murphy's commitment to ensuring that the legislatures original intent with the Auto No-Fault Act is upheld and supported is one of the many reasons why he is one of Michigan's most well respected Judges.

Over the past several years, Michigan's Auto No-Fault System has faced many challenges in the legislature, and in the judicial system as well.  As the election draws closer, it is imperative that we all do whatever we can to support candidates who truly understand just how important Michigan's Auto No-Fault system is to not only our patients and clients, but to anyone who might one day experience a catastrophic auto accident.  While it is crucial to have legislators who support auto no-fault, it is just as important that we have judges who deliver decisions based on how a law or act was written and not from their own interpretation.

To show our support for Chief Judge Murphy, we are asking that you please consider joining us as we attend a fundraiser for him on Tuesday, October 14th from 6:00PM - 7:30PM.  Our good friends at Special Tree along with many other supporters and friend of auto no-fault are putting on this evening reception for Chief Judge Murphy and we hope you will be able to join us.  Please see the attached invitation for further information.

If you are unable to attend this event, but would like to support Chief Judge Murphy's campaign for the Michigan Supreme Court, please consider making a financial contribution to his judicial campaign.  If you have any questions or would like further information, please do not hesitate to contact us at Unique Options. More information on this event is located in the PDF below.

We hope to see you on October 14th!

September Recap

This month has been busy at Unique Options! Between an early BIA Fall Conference and hosting candidate for Governor, Mark Schauer, at our newest building, we have been fortunate to create more buzz and awareness for the TBI community.

Everyone was thrilled to meet with keynote speakers Lee Woodruff and Kevin & Adam Pearce at the 2014 BIA Fall Conference. We loved hearing their inspiring and positive affirmations, and encourage everyone to find an opportunity to hear them present!

After starting the bag trend a few years back, this BIA Fall Conference we showcased our newest clear bags, perfect for fall weather sporting events. Bringing too much to the Detroit Lions games and can't carry it all? We have a few clear bags left that are perfect and approved for stadium goodies! Stop by our office to grab one before they're all gone!

Likewise, Unique Options was honored to showcase Mark Shauer, candidate for Governor, on September 23rd. This evening reception was full of amazing supporters from all areas of the TBI and Auto No-Fault community. We want to thank Mark Schauer for his powerful and strong words of encouragement, and instilling more hope for the future of Michigan.

Thank you to everyone who has supported all of our functions over the past month, and we hope to see you at our next events! Check back for more information on what to expect from Unique Options this fall!
